Declaration of consent
for the transmission of client data
ABES Group AG is an independent insurance broker and has cooperation agreements with all major insurers licensed in Switzerland (including health insurance funds and registered joint/collective foundations). However, it is not legally, economically or in any other way tied to an insurance company within the meaning of Swiss insurance supervision legislation.
ABES Group AG manages clients' insurance contracts in consultation with the relevant insurers. In this sense, it also provides services that lead to a partial reduction in workload for the insurers.
Insurance intermediaries, regardless of their name, are persons who offer or conclude insurance contracts in the interests of insurance companies or other persons or who advise policyholders with regard to the conclusion of an insurance contract or propose insurance contracts (Art. 40 ISA in conjunction with Art. 182a SO).
In certain situations, ABES Group AG may also become active if the address of a potential client has been provided to it by a third party. This pure address brokerage is limited exclusively to the forwarding of contact data by a third party and the client's fundamental interest in a specific consultation or service.
The intermediary undertakes only to clarify the basic interest of potential customers in concluding an insurance contract or in receiving advice and not to provide any insurance or pension advice. The intermediary may not take any legal action on behalf of ABES Group AG or on behalf of an insurance company, and in particular may not make or accept any declarations, provide advice or collect premiums. The third party may only collect general information on insurance and basic data such as company headquarters, name and address, date of birth or contact details. Detailed information on products or services, such as needs analyses or active support in concluding a contract, is prohibited. At the same time, the potential client confirms that he has not taken advantage of any advice from the address broker and does not expect any such advice. He expressly declares that he wishes to be advised exclusively by the ABES Group AG team or its commissioned sales partners or subcontractors.
In order to safeguard and comply with data protection regulations, it is necessary for ABES Group AG to only take action once the client has given express consent to the processing of their personal data. This consent includes in particular the establishment of contact by ABES Group AG as well as the processing of the transmitted data for the purpose of individual advice or the preparation of an offer.
